Homes NSW self-assessment applications (Part 5)
To implement the Tolland Renewal Project, Homes NSW will undertake Part 5 applications in stages across the Tolland Renewal Area.
Council is not a consent authority for Part 5 applications.
Homes NSW has recently commenced assessment on the Part 5 Application for Stage 1A of the Tolland Renewal Project.
What is a Part 5 application?
- Part 5 refers to Part 5 of the Environmental Planning and Assessment Act 1979 (EP&A Act 1979). Division 5.1 of the EP&A Act 1979 means a determining authority – a Minister or a public authority – can assess the environmental impact of certain activities that they are either carrying out themselves or approving.
- These activities are defined as development ‘permitted without consent’ in an Environmental Planning Instrument (EPI) (such as a SEPP or LEP). If an EPI identifies an activity as ‘development permitted without consent’, a proponent will not need to obtain a development consent. Instead, they will need to assess the environmental impacts of the activity through a Division 5.1 assessment referred to as a ‘Review of Environmental Factors’ (REF).
